What does the new Family Care Leave Act bring?
The new Family Care Leave Act came into force in January 2012.
The key points are:
- Employees can reduce their working hours in favor of caring for a relative
- Independent of company size
- Duration of the care phase: maximum two years
- Lower limit for employment: 15 hours per week
- Financial security through advance payment of wages (e.g., full-time employee can reduce working hours to 50% and receive 75% salary)
- Prepaid benefit is recouped when employee returns to full time work (e.g., employee continues to receive 75% salary until benefit is recouped through salary increase)
- Employers receive refinancing for the advance payment from the Federal - Office for Family Affairs and Civil Society Tasks
- The Federal Office also steps in if the employee cannot repay the advance wage payment due to private insolvency
- Employees who take family care leave require insurance coverage (occupational and disability)
- Social security contributions continue to be paid during family care time
